Terms and Conditions
These terms and conditions are an agreement between the Allergy Detective App© creators Ruba Homaidi and Sandi Radomski ("App", "us", "we" or "our") and you ("User", "you" or "your"). This Agreement sets forth the general terms and conditions of your use of the Allergy Detective mobile application and any of its products or services (collectively, "Mobile Application" or "Services").
By accessing this App, any videos or training material associated with it, you accept, without limitation or qualification, the terms and conditions below. If you do not accept these Terms and Conditions, please discontinue your use of this product immediately.
Accounts and membership
While registering for any of the Allergy Detective Program or Webinars, we may collect personally identifiable information, such as your email address, name, address, and telephone number or credit card information.
We may also collect anonymous demographic information, which is not unique to you, such as your occupation, nationality, ZIP code, age, gender, preferences and interests.
Data protection and data security are major priorities for the Allergy Detective creators and management team.
Allergy Detective website and App uses the personal data to process transactions, deliver products or services requested by you, dealing with your enquiries or complaints and other customer care related services. Your personal information may also be used for advertising and internal purposes such as data analysing, and research to improve Allergy Detective products, services and customer communication. Allergy Detective App and Program may also use your personally identifiable information to inform you of other products or services available from the Allergy Detective Team and its affiliates and/or to contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.
The Allergy Detective App and Program will not sell, distribute or lease your identifiable personal information to third parties without your written consent or if as required by law. However, non-personally identifiable information may be provided to other parties for marketing, advertising, or other uses
Prohibited uses and disclaimer
All materials provided in the Allergy Detective App© and related videos and training material on the website or Facebook group or anywhere else, are provided for informational or educational purposes only and are not intended to be, or serve as a substitute for, professional medical advice, examination, diagnosis or treatment.
Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of information you accessed on or through the Allergy Detective App© or any other material on our Website, Facebook group, or any of our Trainings or Webinars.
Intellectual property rights
This Agreement does not transfer to you any intellectual property owned by us, and all rights, titles, and interests in and to such property will remain solely with us. All trademarks, service marks, graphics and logos used in connection with the App or website and related materials are trademarks or registered trademarks of the Allergy Detective App© Licensors.
Limitation of liability
Your use of the Allergy Detective App© or related material, is at your sole risk. Information provided in the App and related material is provided “As Is” and without any representations or warranties of any kind.
To the fullest extent permitted by applicable law, in no event will we, our affiliates and our sponsors, and employees be neither responsible, nor liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages arising out of or relating in any way to the use or misuse the App and it’s related material (including, without limitation, damages for lost profits, revenue, sales, goodwill, use or content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity, health consequences), however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if the App has been advised as to the possibility of such damages or could have foreseen such damages.
Although we have attempted to ensure the integrity and accuracy of the Allergy Detective App© and its related training materials and documentation, we make no guarantees as to the correctness or accuracy of the App and it’s related information.
Indemnification
You agree to indemnify and hold Allergy Antidotes App© and its owners, affiliates, employees, and agents harmless from and against any liabilities, losses, damages or costs, including reasonable attorneys' fees, incurred in connection with or arising from any third-party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your use of the App and related material or any wilful misconduct on your part.
Severability
All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid or unenforceable. If any provision or portion of any provision of this Agreement shall be held to be illegal, invalid or unenforceable by a court of competent jurisdiction, it is the intention of the parties that the remaining provisions or portions thereof shall constitute their agreement with respect to the subject matter hereof, and all such remaining provisions or portions thereof shall remain in full force and effect.
Dispute resolution
The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of Delaware, United States without regard to its rules on conflicts or choice of law and, to the extent applicable, the laws of United States. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the state and federal courts located in Delaware, United States, and you hereby submit to the personal jurisdiction of such courts. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.
Changes and amendments
We reserve the right to modify this Agreement or its policies relating to the Allergy Antidotes App© and related material at any time, effective upon posting of an updated version of this Agreement in the Allergy Antidotes App©. When we do, we will revise the updated date at the bottom of this page. Continued use of the Mobile Application after any such changes shall constitute your consent to such changes.
Acceptance of these terms
You acknowledge that you have read this Agreement and agree to all its terms and conditions. By using the Mobile Application or its Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Mobile Application and its Services.
